Two Massachusetts Dates in the Next Four Weeks
If you are running or relying on a background check in Massachusetts this month, two dates sit just outside it and change what the person on the other side of the counter is supposed to have done.
October 28, 2026 — registration and serialization. The compliance deadline for the requirements in M.G.L. c.140 §§ 121B and 121C. The Act did not set that date itself; it set the clock running from when the Commonwealth finished building the systems, so the date comes from the state. EOPSS guidance issued September 18, 2026 gives it: individuals are not required to comply with the registration and serialization requirements in those two sections until October 28, 2026, pursuant to section 157 of An Act Modernizing Firearm Laws. Both systems are already live in the MIRCS portal, so there is nothing to wait for.
If you saw a different date, you were not imagining it. An earlier EOPSS memorandum gave 10/2/2026 for registration. The September 18, 2026 guidance is the later document and it is the one that names October 28 and covers serialization as well. Work to the later date.
November 3, 2026 — Question 9. A referendum on whether to keep or repeal Chapter 135 of the Acts of 2024, which is the law those requirements come from. A yes keeps it. A no repeals it. A successful repeal takes effect when the result is certified, which follows the election rather than coinciding with it.
The two do not cancel out. Chapter 135 is in force now and is not suspended while the vote is pending, so the October 28 deadline stands whichever way you intend to vote and whichever way the vote goes — it falls six days before the election. After November 3, check the Commonwealth's own guidance rather than this page.
