Alabama Gun Inheritance laws are the state and federal rules that govern how firearms pass from a deceased owner to their heirs. When a gun owner passes away, their firearms become part of their estate. The legal process of transferring those firearms to the rightful heir — whether through a will, a trust, or state intestate succession — is governed by a combination of federal law and state law. Some states impose specific requirements like background checks, FFL transfers, or registration. Alabama is one of the most straightforward states in the nation — no state-specific requirements beyond federal law apply. Compare gun inheritance laws in every state →
Alabama Gun Laws 2026 do not require heirs to: obtain a permit to possess inherited firearms, register inherited firearms with any state or local authority, notify local law enforcement of the transfer, or process the inheritance through a licensed FFL. The executor may simply transfer the firearms to the eligible heir. For NFA-regulated items, federal ATF Form 5 requirements apply regardless of state — see the NFA and Gun Trusts section below.
Dealer involvement may be required when:
| Scenario | Background Check | FFL Required | Key Notes |
|---|---|---|---|
| Inherit non-NFA firearm (in-state heir) | Not Required | Not Required | Direct transfer from estate executor to eligible heir. No Alabama state forms required. Document with a bill of sale. |
| Inherit non-NFA firearm (out-of-state heir) | Not Required in AL | Not Required | Federal law allows direct interstate inheritance without FFL. Heir must comply with their home state laws. |
| Inherit NFA item (suppressor, SBR, machine gun) | ATF Form 5 Required | Not Required | Tax-exempt transfer. Executor submits ATF Form 5. Heir cannot possess until ATF approves. Processing takes months. |
| Sell inherited firearm (private sale) | Not Required | Not Required | Alabama has no UBC requirement. Buyer must be legally eligible. Use GunTransfer.com to document the sale. |
| Sell inherited firearm (through FFL) | Required | Required | FFL handles ATF Form 4473 and background check. Recommended for large collections or uncertain buyer eligibility. |
| Unregistered NFA item found in estate | Cannot Transfer | Contact ATF | Federal contraband — cannot be inherited, registered, or sold. Executor must contact local ATF field office immediately for voluntary abandonment. |
